How to be transferred to the rear for family reasons.


A serviceman of the Armed Forces of Ukraine, whose wife is expecting their third child, can submit a report for transfer to a rear unit due to family circumstances. However, the decision on this rests with the commander of his military unit.
According to the portal 'Lawyers.UA', lawyer Yuriy Aivazyan provided clarification on this matter, responding to a citizen's inquiry.
The commander's right, not an obligation
The lawyer emphasized that the serviceman has the right to submit a report for transfer due to family circumstances, but deciding to accept this report is up to the commander.
'Your husband has the right to submit a report to the unit commander for relocation to another military unit due to family circumstances',the lawyer stressed.
However, the lawyer noted that the resolution of this issue lies within the competence of the commander of the military unit, and it is not mandatory.
Mandatory conditions for transfer
Aivazyan also stressed that for a successful transfer of a serviceman, three conditions must be met:
- to be associated with the unit to which the transfer is planned;
- to have grounds for relocation;
- to prove the necessity of transfer to the commander of their unit.
Let us remind that earlier we discussed situations where a serviceman cannot be transferred without their consent, as well as the possibility of transferring a serviceman to a lower position.
This story once again highlights the importance of addressing family-related issues for servicemen and reflects the process of interaction between them and their commanders in the Armed Forces of Ukraine.
